Se trata de un caso en el que el testador en su testamento dejó todos sus bienes a título universal a los hijos de su segundo matrimonio, los aquí demandados, con preterición de los hijos de su primer matrimonio, los aquí demandantes. Este Tribunal anuló la institución de herederos y declaró la intestacia total.

Los demandados han presentado un recurso de reposición alegando (1) que no existe preterición en cuanto a los hijos del primer matrimonio que han recibido su parte en los bienes dejados por el testador, y (2) que, aun suponiendo que hubiera habido preterición, el efecto no sería la anulación de la institución de herederos sino simplemente la reducción del legado que se les hizo.
