El impuesto español sobre sucesiones y donaciones es un impuesto nacional, pero el Gobierno español lo cedió a los organismos regionales (comunidades autónomas), que tienen autonomía para legislar y recaudar el impuesto. Las comunidades autónomas han legislado una serie de beneficios fiscales que son aplicables a los contribuyentes, residentes en sus regiones.

El punto clave es que la mayoría de las CCAA han introducido beneficios fiscales a sus residentes, es decir, en Baleares (Mallorca, Ibiza o Menorca) las transmisiones de herencias entre familiares directos, si son residentes, tributan con un máximo del 1% en la mayoría de las herencias.

El problema es cuando hablamos de residentes no españoles porque el impuesto no se traslada a los organismos autonómicos y se aplican las normas estatales sin dichos beneficios. Esto implicaba que en el pasado una persona no residente en España pagaba un Impuesto de Sucesiones más alto que una persona residente en ese país. Esto suponía una clara discriminación en el seno de la UE y muchos colectivos de particulares y profesionales afectados denunciaron ante los Tribunales de la UE.
